The conception of the New World from the critique of natural law in Montaigne

Abstract

Montaigne’s notion of the New World sharply contrasts with that of the
Spanish Scholastic thinkers of the 16th century. For them, the notion of ‘natural
law’ was indispensable for justifying and reflecting on the Spanish dominion
over America. Remarkably, in several of his essays, Montaigne criticized this
iusnaturalistic concept of the law. To what extent could this have conditioned his
approach to the Amerindian? Essays of the sort of “The Cannibals” do not in fact
suppose a distance from the belief that there are universal and necessary laws that
determine what should be human in general?
